2 These conditions shall be deemed to be incorporated in all contracts of AdvantageMedia to sell goods and in the case of any inconsistency with any order or form of contract sent by the purchaser to AdvantageMedia whatever may be their respective dates the provision of these Conditions shall prevail unless expressly varied in writing and signed by a director on behalf of AdvantageMedia.

3 Notwithstanding that AdvantageMedia may have given a detailed quotation no order shall be binding on AdvantageMedia unless and until it has been accepted in writing by AdvantageMedia.

4 Any times or dates given for completion or delivery of goods shall be binding on AdvantageMedia, insofar as AdvantageMedia undertake to carry out additional work for the purchaser to the value of the print element of any goods not supplied on time. Such liability shall not extend to delays beyond the control of AdvantageMedia including, without prejudice to the generality of the foregoing defects in files or omissions of information delays in approval of proofs and non-performance of carriers.

5 By their nature goods do not have a redeemable value and no refunds or credits for goods correctly supplied will be entertained. If the claim is made under the Satisfaction Guarantee, the claim will only be accepted once the print is returned in its entirety and a reprint will be made at our earliest convenience.

a) All goods shall be paid for at the time of order.
b) No goods shall be dispatched or collection allowed until paid for in full.
c) All prices are inclusive of Value Added Tax (Some leaflets, flyers and brochures are zero rated in accordance with HM Revenue & Customs rules and guidelines. More information is available from HM Revenue & Customs) and this is charged at the appropriate rate. If we are unable to ascertain whether a print job is subject to VAT we will charge VAT at the standard rate and seek clarification from HM Revenue & Customs. Unless otherwise stated.

a) Any shortcomings or defects in goods supplied must be notified in writing to AdvantageMedia within 3 days of delivery. Such goods must be returned to AdvantageMedia for inspection (initially at the customers expense, if the defect is found to be the fault of AdvantageMedia you will be reimbursed the cost of return upto a maximum of the initial shipping fee paid). If the goods are not returned Advantage Media will not refund any part of the payment.

b) Nothing herein shall impose any liability upon AdvantageMedia in respect of any defect in the goods arising out of the acts, omissions, negligence or default of the Purchaser, its servants or agents including without prejudice to the generality of the foregoing handling and storage of the goods.

c) Nothing herein shall have the effect of excluding or restricting the liability of AdvantageMedia:
i.) For death or personal injury resulting from its negligence insofar as the same is prohibited by U.K. statute, or;

ii.) Under sections 12,13,14 and 15 of the Sale of Goods Act 1979 to a purchaser who is dealing with a customer (as defined by section 12 of the Unfair Contract Terms Act 1977).

8 AdvantageMedia shall not be liable for any costs, claims or damage arising out of any act of tort or omission or breach of contract or statutory duty calculated by reference to profits, income production or accruals or loss of such profits, income production or accruals or by reference to accrual of such, claim, damages or expenses on a time basis.

9 The liability of AdvantageMedia to the purchaser for any loss or damage of whatsoever nature and howsoever caused shall be limited to and in no circumstances exceed the price of the goods.

10 If the purchaser shall be in breach of any of their obligations under the contract AdvantageMedia may (without prejudice to AdvantageMedias rights subsequently to determine the contract for the same cause should it so decide) suspend further deliveries of goods without notice until any defaults by the purchaser are remedied.

11 No statement, description, information, warranty or recommendation contained in any catalogue, price list, advertisement or communication or made verbally by any of the agents or employees of AdvantageMedia shall be construed to enlarge, vary or override in any way these conditions.

12 Any concessions made or latitude allowed by AdvantageMedia to the purchaser shall not affect the strict rights of AdvantageMedia under the contract. If in any particular case any of these conditions shall be held to be invalid or shall not apply to the contract the other conditions shall continue in full force and effect.

13 Upon sight of artwork and at its sole discretion AdvantageMedia reserve the right to decline to print any item it deems to be inappropriate. Any payments made for work rejected by reason of this clause will be refunded in full.

14 The contract shall in all respects be governed by English law and shall be deemed to have been made in England and the purchaser and AdvantageMedia agree to submit to nonexclusive jurisdiction of the English courts.

15 Imprint, AdvantageMedia reserve the right to discreetly add to your final artwork on flyers and posters. It reads, in 5 point type, "www.advantagemedia.co.uk 08452 570 575". You may choose to omit this imprint from your order (for example, if you are reselling our products) you will notify us in writing with each order placed.

16 Cancellation, AdvantageMedia will charge an adminsitration fee of £10 for all order cancellations which occur prior to any works being carried out on the order. Due to the nature of print once works have been carried out cancellation will incur charges based on works carried out.

17 Colour Variance, AdvantageMedia will not be held responsible for variances due to differing print processes used. Colour matching from order to order must be requested in writing with order and must have an approved and signed referance such as a press matched proof. Due to the nature of batch printing all print is "run to levels" but AdvantageMedia is unable to gaurantee colour match.

18. Flyer Paper (Stock): In common with most printers of flyers, we quote a stock weight of 300gsm. 300gsm means that 1 square metre of the stock weighs 300 grammes. This is a nominal figure and most paper manufacturers only guarantee this plus or minus 10%; i.e. the stock can be anywhere between 270gsm and 330gsm. This weight figure does NOT indicate the thickness or stiffness of the stock, (the most obvious attribute by which most people judge the quality), which means that one make of 300gsm stock will be a different thickness to another manufacturers 300gsm. It is also no measure of the whiteness or the gloss level which is another important consideration we have to take into account. To be able to offer our very competitive prices, we source our stock from various suppliers depending on who is the most competitive when we place our contracts. To ensure that we have a yardstick by which to judge these various stocks, we base our purchasing decisions on the specification of Arjo Wiggins Maine Gloss. This is a high quality FSC stock which is specified as 300gsm and has a thickness of approximately 230 microns. WE GUARANTEE THAT WE WILL NOT USE ANY STOCK WHICH HAS A WEIGHT/THICKNESS SPECIFICATION OF LESS THAN THIS OR WHICH HAS A SUBJECTIVELY DIFFERENT WHITENESS OR GLOSS LEVEL, WHICH MAY AFFECT THE PRINTED RESULT.
